A Yobe State Magistrate court sentenced Umar Alhaji Mustapha to 25 years in prison for an incestuous relationship with his 18-year-old daughter Fatima.
The presiding Magistrate, Mohammed Bilyaminu, ruled that the prosecution had proven all of the ingredients of sections 390 and 283 of the criminal code.
According to the Nation, when reading the witness evidence, the court stated that PW 1, a police inspector, established the offender had multiple sexual encounters with his daughter against her consent, resulting in pregnancy. The infant, unfortunately, died shortly after birth.
The court also stated that the prosecution was able to establish that the accused, after impregnating the daughter, gave her N25,000 to abort the pregnancy, which she refused.
Fatima, the victim during cross-examination, said that her father grew very upset with her after discovering she was pregnant and refused to heed his order to abort the pregnancy, threatening her.
The defendants were found guilty of incest and rape under sections 390 and 283 of the criminal code by Chief Magistrate Mohammed Bilyaminu.
He sentenced him to five years in prison and an N5,000 fee for incest and 20 years in prison and an N10,000 fine for rape, respectively.
Before the verdict was read, the accused was given the opportunity to ask for compassion, which he did, urging that the court temper justice with kindness.
“I have an aged mother and other dependents to take care of,” the accused said.
The convict has 30 days from the date of the judge’s decision to file an appeal.
